Terms and Conditions
1. General
These General Terms and Conditions apply to all types of orders (Internet, fax, telephone) and also to all future business that the customer concludes with La bottega del caffè GmbH. Deviating or supplementary provisions, verbal agreements, or conditions of the customer will only be legally recognized if they have been confirmed in writing by La bottega del caffè GmbH. La bottega del caffè GmbH reserves the right to make technical changes and improvements without prior notice. La bottega del caffè GmbH rejects any obligation in the case of obvious errors such as typing or calculation errors.
2. Offer and Conclusion of Contract
2.1 The presentation of products [in the online shop] does not constitute a legally binding offer, but rather
an invitation to the customer to place a binding order (offer to conclude a contract).
2.2 By clicking the order button, the customer places a binding order for the products listed on the order page.
2.3 Immediately after receipt of the order, the seller confirms receipt of the order by e-mail. The purchase contract is only concluded when the seller confirms the dispatch of the goods by e-mail (order or shipping confirmation) or, at the latest, upon delivery of the goods.
2.4 In the case of payment in advance, the purchase contract is concluded upon confirmation of receipt of the advance payment by the seller.
3. Warranty Conditions
3.1 The warranty conditions mentioned in the contract apply.
3.2 Repairs caused by the use of capsules, pads, etc. not sold by La bottega del caffè GmbH, improper operation, manipulation, incorrect installation, fire, water, or theft damage, as well as wear and tear on the housing, are generally excluded from the warranty.
3.3 Periodic descaling is excluded from the warranty.
3.4 The warranty expires as soon as changes or repairs are carried out by unauthorized third parties.
3.5 Warranty claims are handled via a bring-in service. The defective product must be sent to the specified address at the buyer's expense or delivered in person.
4. Prices and Payment Terms
Prices are net payable, usually by common instant payment methods (Twint, credit card, advance payment, etc.) or, after review by the seller, by invoice within 30 days from the invoice date, including statutory VAT. Price changes due to adjustments to the statutory VAT rate will be passed on to the buyer without prior notification. Price changes caused by manufacturers or third parties remain reserved.
5. Online Shop and Website
5.1 Personal data and information that reaches La bottega del caffè GmbH via the Internet will be handled by La bottega del caffè GmbH in compliance with the applicable data protection law. For further information, please consult our data protection policy on our website.
5.2 The Internet services provided by La bottega del caffè GmbH are subject to technical availability, especially with regard to failures due to technical malfunctions.
5.3 La bottega del caffè GmbH rejects any form of compensation. It is the responsibility of the registered user to handle the access code to the online shop carefully and thus prevent false or unwanted orders by third parties.
5.4 La bottega del caffè GmbH delivers devices and products exclusively to customers residing in Switzerland and the Principality of Liechtenstein.
5.5 As a service to visitors, the website may contain hyperlinks to other Internet addresses. These are neither controlled nor operated by La bottega del caffè GmbH. La bottega del caffè GmbH is not responsible for these websites and therefore disclaims all liability regarding their accuracy, content, legality, and function.
5.6 The content of the La bottega del caffè GmbH website is protected by copyright and may not be used, distributed, modified, transmitted, or reused for public or commercial purposes without written permission.
6. Complaints and Returns
Complaints due to incorrect or faulty delivery must be reported to La bottega del caffè GmbH within 3 days of receipt of the goods. Any returns must be in their original packaging, unused, with the reason for return, and without any signs of use. Should one of the above conditions not be met, we reserve the right to invoice the items despite their return.
7. Shipping Costs
7.1 The customer pays a shipping cost contribution per delivery. Further information and tariffs can be found on our website under "Shipping".
7.2 Return shipping fees due to non-collection of goods deliveries will be fully charged to the customer.
7.3 The customer can either bring the device to be repaired to the La bottega del caffè GmbH sales outlet or send it by post at their own expense.
7.4 The customer is fully liable for any transport damage when sending in devices.
8. Right of Return
8.1 Right of withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason.
8.2 Withdrawal period: The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
8.3 Consequences of withdrawal: If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which the notification of your withdrawal from this contract has been received by us. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment.
8.4 Return: You must return or hand over the goods to us without undue delay and in any case no later than 14 days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of 14 days. You bear the direct costs of returning the goods.
8.5 Exclusion of the right of withdrawal: The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
9. Retention of Title
Until full payment of the purchase price, all items and related rights remain the property of La bottega del caffè GmbH. In the event of the customer's bankruptcy, La bottega del caffè GmbH is entitled to collect unpaid goods.
10. Dunning and Collection Fees
10.1 In case of default in payment, dunning fees of at least CHF 20.- per reminder will be charged.
10.2 We are entitled to send a written reminder to the customer in case of default in payment.
10.3 In addition to the dunning fees, default interest will be charged at the statutory rate.
10.4 In case of persistent default in payment, we are entitled to commission Creditreform with the collection.
10.5 The collection fees incurred are based on the currently valid tariffs of Creditreform.
11. Data Protection

12. Place of Jurisdiction
In the event of legal disputes, the parties agree on the exclusive jurisdiction of the courts in 5600 Lenzburg (AG). These General Terms and Conditions are governed by Swiss law.
